2. About these terms
These terms govern your use of www.somuk.co.uk and, where relevant, your membership of SoMUK and your booking of our training courses and congresses.
By using this website you accept these terms. If you do not accept them, please do not use the site.
We may change these terms from time to time. The version in force is the one published on this page when you use the site or make a booking. We will tell members by email about material changes.
3. Using the website
3.1 Availability
We try to keep the website available at all times but we do not guarantee it. We may suspend, withdraw or restrict all or part of the site for business or operational reasons, and we will give reasonable notice where we can.
3.2 Acceptable use
You may use the website for lawful purposes only. You must not:
- use it in any way that breaches any applicable law or regulation
- attempt to gain unauthorised access to the site, its server, or any connected database
- introduce viruses, trojans, worms or other malicious material
- attack the site by denial-of-service or any similar means
- scrape, harvest or systematically extract data from the site, including the practitioner directory, for any purpose
- reproduce, republish or redistribute our content except as permitted below
We will report any breach of this section to the relevant authorities and will co-operate with them, including by disclosing your identity.
3.3 Accuracy of information
We take care over the content of this website, but it is provided for general information. We do not warrant that it is accurate, complete or up to date. Guidance on professional practice changes, and you must satisfy yourself of the current position before relying on anything published here.
4. Intellectual property
We own or are licensed to use all intellectual property rights in this website and in the material published on it, including the SoMUK name and logo. These are protected by law.
You may print or download extracts for your own personal or internal professional use. You must not modify them, use any illustration or photograph separately from its accompanying text, or use any part of the site for commercial purposes without our written permission.
Our status as the authors of the content must always be acknowledged.
5. Professional information — an important limitation
The content of this website is intended for healthcare and aesthetic professionals. It is professional and educational information about mesotherapy practice.
It is not medical advice, and it is not a substitute for clinical judgement, appropriate training, or the manufacturer’s instructions for any product. Nothing on this site should be relied on by a member of the public to decide whether to undergo any treatment.
Any practitioner acting on information published here remains wholly responsible for their own clinical decisions, for the products they use, for holding appropriate qualifications, registration and indemnity insurance, and for compliance with the law applicable where they practise.
6. Membership
SoMUK offers a single category of membership. It is open to practitioners who meet the eligibility criteria published on the website, and we may ask for evidence of qualifications, professional registration and indemnity insurance.
- Membership runs for the period stated at the time of joining, at the fee published on the website, and is renewable.
- Membership fees are payable in advance.
Membership is personal to you and must not be transferred, lent or shared. Allowing another person to use your membership in order to obtain any benefit of membership — including a member rate, a directory listing, or access to a member event — will result in the immediate cancellation of your membership without refund, and we reserve the right to recover from you the value of any benefit obtained.
- Membership does not confer any licence, registration or authorisation to practise. SoMUK is not a regulator and membership does not replace any statutory registration you may require.
- We may suspend or terminate membership where a member breaches these terms, brings the Society into disrepute, or ceases to meet the eligibility criteria.
7. Training courses
7.1 Booking and eligibility
A booking is confirmed when we have received payment (or the required deposit) and have sent you written confirmation. Until then no contract exists.
Our courses have professional entry requirements. You must give accurate information about your qualifications, registration and insurance. We may decline or cancel a booking where the requirements are not met, and we may require documentary evidence before the course.
You must hold appropriate professional indemnity insurance covering the techniques taught before practising them on patients. Attending a course does not itself provide insurance cover.
7.2 Fees, deposits and payment
Fees are as published at the time of booking and are exclusive of VAT. VAT is charged in addition at the prevailing rate by PHP Health First Ltd, which is VAT registered. Payment is due in full before the course begins unless we agree otherwise in writing.
Where a deposit or part-payment is required to secure a booking, the amount and the payment schedule will be stated clearly at the time of booking.
Course fees are collected by SoMUK on behalf of PHP Training Academy, which provides the training.
7.3 If you cancel
Cancellation and rescheduling requests must be made by email to corine@somuk.co.uk. We cannot accept them by telephone or WhatsApp, because we need a written record of the date on which the request was made. The date we receive your email is the date used to calculate any refund.
| Notice given before the course date | Refund of course fees paid | Notes |
| More than 60 calendar days | Full refund | No deduction |
| Between 60 and 30 calendar days | 75% refunded | Up to 25% may be retained for administrative costs and costs already incurred |
| Between 29 and 14 calendar days | 50% refunded | Reflects costs already committed at this stage |
| Less than 14 calendar days | No refund normally provided | Costs will usually already have been incurred and the place may not be re-filled |
| Non-attendance without prior written cancellation | Course fee remains payable | Please tell us in advance if you cannot attend |
Any amount retained will be limited to the reasonable costs and losses resulting directly from the cancellation, taking into account any reasonable steps available to us to reduce those losses. The same provisions apply to any deposit or part-payment.
7.4 Rescheduling
Where sufficient notice is given, you may ask to transfer your booking to another available course date instead of cancelling. Rescheduling is subject to availability and may be subject to reasonable costs already incurred in connection with the original date, including venue, trainer or model costs.
7.5 Substitution — sending a colleague in your place
Instead of cancelling, you may transfer your place to another delegate. There is no charge for this.
The substitute must meet the entry requirements for the course. Please tell us in writing as early as you can, and give us the substitute’s details and evidence of their qualifications, registration and indemnity insurance in good time, so that we can verify their eligibility before the course begins. We may decline a substitution where the entry requirements are not met.
Where a substitution is accepted, the original payment is applied in full to the substitute’s place and no cancellation charge arises.
7.6 If we cancel or reschedule
In exceptional circumstances, SoMUK and/or PHP Training Academy may need to cancel or reschedule a course, including where circumstances arise that are beyond our reasonable control.
Where a course is cancelled and the training has not been provided, you will be offered the choice of:
- a full refund of all course fees paid; or
- a transfer to another available course date of your choice, subject to availability.
No administration or cancellation fee is deducted from a refund where the course is cancelled by us. Where you choose to transfer, your original payment is applied in full to the replacement date. We will make reasonable efforts to give as much notice as possible.
We are not responsible for travel, accommodation or other costs you incur as a result of a cancellation or change of date. We recommend that you insure against these.
7.7 Models and practical sessions
Where a course involves treating models, treatment is carried out under supervision. Models attend voluntarily and give their own consent. Arrangements for models will be confirmed at the time of booking.
7.8 Certification
Certificates are issued on successful completion of the assessment requirements for the course. A certificate records that you completed the training. It is not a qualification awarded by a regulator, and it does not by itself entitle you to practise, to obtain insurance, or to hold yourself out as accredited in any other respect.
8. Congress information
This website publishes information about mesotherapy congresses, including those we accredit and those organised by other societies and third parties.
SoMUK does not sell or administer places at these congresses. Bookings, payments, cancellations and refunds are matters between you and the organiser of the event concerned, on that organiser’s terms.
Programmes, speakers, dates and venues are as published by the organiser and may change. We publish what we are told and update it as we can, but we do not warrant that congress information on this site is accurate or current, and we are not responsible for the organisation, content, safety or conduct of an event run by others.
9. The practitioner directory
The directory lists practitioners who are members of SoMUK and have asked to be included.
- A listing confirms membership. It is not a recommendation, endorsement or warranty of any individual’s competence, conduct or results.
- Members are responsible for the accuracy of their own entry and must tell us promptly if it becomes out of date.
- We may remove or amend an entry at our discretion, including where membership lapses or where information appears inaccurate or misleading.
- Members of the public should make their own enquiries before choosing a practitioner, including about qualifications, registration and insurance.
- The directory must not be copied, scraped or used to build a mailing list.
10. Congress accreditation and sponsors
Where we accredit a third-party congress, that accreditation relates only to the criteria published for it. We are not responsible for the organisation, content, safety or conduct of events run by others.
Sponsorship does not imply that we endorse a sponsor’s products. Members and delegates must form their own view of any product, and must follow the manufacturer’s instructions and the applicable regulations.
11. Links to other websites
Where we link to other sites, including those of partner societies, sponsors and PHP Training Academy, those links are provided for information. We have no control over the content of those sites and accept no responsibility for them or for any loss arising from your use of them.
12. Our liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.
Subject to that:
- We exclude all implied conditions, warranties and representations to the fullest extent permitted by law.
- We are not liable for any loss of profit, loss of business, loss of anticipated savings, loss of goodwill, or any indirect or consequential loss.
- Our total liability in connection with any course, congress or membership is limited to the fees you paid for it.
- We are not liable for any loss arising from your clinical practice, or from your use of any technique or product, whether or not it was taught or discussed on one of our courses.
If you are dealing with us as a consumer rather than in the course of a business, nothing in these terms affects your statutory rights.
13. Consumer cancellation rights
Most of our delegates and members contract with us in the course of their profession. Where you are contracting as a consumer and enter into a distance contract, you may have a statutory right to cancel within 14 calendar days under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Where a course is due to begin before the end of that 14-day period, we will ask you to confirm expressly that you wish the training to begin before the cancellation period has expired.
If you make that request and then exercise your statutory right to cancel before the training has been fully performed, you may be required to pay a proportionate amount for the training already provided up to the date on which you notify us of your cancellation.
Where the course has been fully performed following your express request, you may lose your statutory right to cancel, provided you acknowledged this before the training began.
The following declaration appears on the booking form where a course begins within 14 days of booking:
| ☐ | I expressly request PHP Training Academy to begin providing the training before the expiry of my 14-day cancellation period. I understand that if I cancel after the training has begun, I may be required to pay for the proportion of the training already provided, and that I may lose my statutory right to cancel once the training has been fully performed. |
14. Data protection
We process personal data in accordance with our Privacy Notice, published on this website. It explains what we collect, why, how long we keep it, who we share it with, and your rights under the UK GDPR.
15. Complaints
If something goes wrong, please tell us. We would always rather hear about a problem early and put it right.
15.1 How to complain
Send your complaint by email to corine@somuk.co.uk. Please set out what happened, when, and what you would like us to do about it. Complaints must be made in writing so that we have a clear record of what was raised and when.
15.2 What happens next
| Stage | What we do | Timescale |
| 1. Telephone discussion | We telephone you to discuss your complaint directly, understand what has happened, and try to reach an agreement with you. | Within 14 days of receiving your complaint |
| 2. Written response | We confirm in writing what was discussed and what has been agreed, or explain our final position if no agreement was reached. | Within 14 days of the telephone discussion |
Where we are unable to reach you by telephone after reasonable attempts, we will respond to your complaint in writing instead, within the same timescale.
15.3 If we cannot resolve it between us
Where a complaint concerns a course, a refund, a membership decision or any other service matter, and we have not been able to agree a resolution, you retain all your legal rights. There is no ombudsman or regulator for this kind of complaint, but you may:
- take the matter to the courts, including through the small claims procedure
- where you paid by credit or debit card, ask your card provider about a chargeback or, for credit card payments over £100, a claim under section 75 of the Consumer Credit Act 1974
- seek independent advice, for example from Citizens Advice
15.4 Complaints about your personal data
A complaint about how we have handled your personal data is treated differently. Please raise it with us first, at contact@somuk.co.uk marked “Data protection complaint”. We will acknowledge it within 30 days and respond without undue delay.
If you remain dissatisfied, you may complain to the Information Commissioner’s Office, which is the UK regulator for data protection: Wycliffe House, Water Lane, Wilmslow, Cheshire SK9 5AF · 0303 123 1113 · www.ico.org.uk. You may go to the ICO at any time; complaining to us first does not affect that right.
Please note: the ICO can only consider complaints about the handling of personal data. It cannot consider complaints about a course, a refund, a fee or a membership decision, and will not investigate them.
Our Privacy Notice explains your data protection rights in full.
16. General
- If any provision of these terms is found to be unenforceable, the rest remain in force.
- If we do not insist on a right immediately, that does not prevent us from enforcing it later.
- These terms are between you and us. No other person has any right to enforce them.
- These terms, their subject matter and their formation are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction.
